Terms of Service
Last updated 1 June 2026. These terms apply to all Fit System accounts and services.
1. Who we are
Fit System is operated from Australia and provides gym and personal trainer management software on a subscription basis. References to "we", "us" or "our" mean Fit System. References to "you" or "your" mean the business that holds the account.
2. Your account
You're responsible for keeping your login credentials secure, for the activity of all staff users you invite, and for ensuring the information you store in Fit System is accurate. We may suspend access if an account is used in breach of these terms or applicable law.
3. Fees and payment
Subscriptions are billed monthly in advance via Stripe in Australian dollars unless agreed otherwise in writing. Setup fees are one-off and non-refundable once work has commenced. Subscriptions continue month-to-month and can be cancelled with 30 days' notice via your account or by emailing hello@fitsystem.com.au.
4. Your data
You own the data you put into Fit System (members, leads, payments, content). We process it on your behalf to provide the service, in line with our Privacy Policy. On cancellation, you can request an export of your data for up to 30 days after the account closes.
5. Acceptable use
Don't use Fit System to send spam, store unlawful content, attempt to breach the platform's security, or resell the service without a written partner agreement.
6. Uptime and changes
We work hard to keep Fit System available but don't guarantee uninterrupted service. We may add, change or retire features over time; material changes that affect your subscription will be communicated in advance.
7. Liability
To the maximum extent permitted by law, our total liability to you for any claim arising out of or in connection with the service is limited to the fees you paid in the 3 months before the event giving rise to the claim. Nothing in these terms excludes any rights you have under the Australian Consumer Law that cannot lawfully be excluded.
8. Governing law
These terms are governed by the laws of Australia. Any disputes will be handled in the courts of the state in which Fit System is registered.
